Activated Sports Performance

These Terms & Conditions (“Terms”) govern your use of the Activated Sports Performance website, programs, memberships, and services. By accessing our website or enrolling in any program, you agree to the following terms.

1. Acceptance of Terms

By registering for services, participating in training, or using our website, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

If the participant is under 18 years of age, a parent or legal guardian must agree on their behalf.

2. Program Participation

Participation in sports performance training involves physical activity and inherent risk. By enrolling, you acknowledge and accept these risks.

All athletes must:

  • Be medically cleared to participate

  • Follow coach instruction

  • Adhere to program rules and code of conduct

Activated reserves the right to suspend or remove any participant who fails to meet conduct standards.

3. Payment Terms

  • All memberships and training packages must be paid in full or according to agreed billing schedules.

  • All sales are final. No refunds will be issued unless otherwise stated in writing.

  • Missed sessions do not automatically roll over.

  • Failure to make payments may result in suspension of services.

4. Cancellations

  • Membership cancellations require written notice (minimum 14 days prior to the next billing cycle).

  • No prorated refunds will be issued.

  • Special events, camps, or tournaments are non-refundable unless canceled by Activated.

5. Intellectual Property

All website content, branding, logos, training materials, and media are the property of Activated Sports Performance and may not be copied, distributed, or used without written permission.

6. Media Release

By participating in Activated programs, you grant permission for the use of photos and videos for marketing, promotional, and educational purposes unless written notice opting out is provided.

7. Limitation of Liability

Activated Sports Performance, its owners, coaches, staff, and affiliates are not liable for injuries, damages, or losses sustained during participation, except as required by law.

Participants assume full responsibility for any risks associated with training activities.

8. Website Use

You agree not to:

  • Use the website for unlawful purposes

  • Attempt to disrupt or hack site functionality

  • Submit false information

Activated reserves the right to restrict access to users who violate these terms.

9. Third-Party Services

Activated may use third-party platforms for payment processing, scheduling, or communication. We are not responsible for the policies or practices of those third-party providers.

10. DBA & Nonprofit Status

Activated Sports Performance operates as a DBA (Doing Business As) under Path to Purpose, a registered nonprofit organization (Tax ID: 33-2144400).

11. Modifications

Activated reserves the right to update or modify these Terms & Conditions at any time. Updated terms will be posted on this page with a revised effective date.
